1. About market.com.sg

market.com.sg ("we", "us", "our") is an online search and directory platform that helps users discover highly rated products, services, and attractions in Singapore. Our search results are powered by Google, curated to display only the best where you are or where you want to go in Singapore.

These Terms & Conditions constitute a binding agreement between you and us governing your access to and use of our website at https://market.com.sg and our mobile applications for iOS and Android (together, the "Platform"). References to the website apply equally to the apps unless we say otherwise. Sections 19 and 20 set out additional terms that apply only to the apps.

2. Acceptance of Terms and Data Consent

By accessing or using market.com.sg, you confirm that:

• You are at least 18 years of age;
• You have read, understood, and agree to be bound by these Terms & Conditions;
• You have read and consent to our Privacy Policy, including the collection, use, and disclosure of your personal data as described therein; and
• Where you are using the site on behalf of an organisation, you have the authority to bind that organisation to these terms.

By using this website, you consent to us collecting, using, and disclosing your data — including search behaviour, usage data, and device information — in accordance with our Privacy Policy, the Personal Data Protection Act 2012 (PDPA) and all relevant legislation and regulations. This may include sharing data with advertisers, business partners, market research organisations, and other third parties as described in our Privacy Policy.

Your continued use of the platform constitutes ongoing acceptance of these terms and ongoing consent to our data practices, as updated from time to time.

3. Data Collection, Use, and Disclosure

market.com.sg collects data generated through your use of this website, including but not limited to search queries, browsing behaviour, location data (if provided), device and technical information, and any content you voluntarily submit.

We may use this data for lawful purposes consistent with the PDPA, including:

• Operating and improving the platform;
• Providing targeted or interest-based advertising;
• Sharing or disclosing data (including aggregated and de-identified data) with third parties such as advertisers, business partners, and market research organisations, where permitted under the PDPA;
• Providing commercial intelligence and analytics products to third-party organisations, where permitted under the PDPA; and
• Any other purpose consistent with our Privacy Policy and applicable Singapore law.

By using market.com.sg, you acknowledge and agree that your personal data may be shared with third parties in accordance with our Privacy Policy and the PDPA. Full details of our data practices are set out in our Privacy Policy.

If you do not wish your data to be used as described above, you must discontinue use of this website. You may contact our Data Protection Officer at support@market.com.sg to request access to, correction of, or withdrawal of consent for the use of your personal data in accordance with the PDPA.

4. Use of the Platform

You agree to use market.com.sg only for lawful purposes and in a manner consistent with all applicable Singapore laws and regulations, including the Consumer Protection (Fair Trading) Act 2003 and the Spam Control Act 2007. You must not:

• Post false, misleading, or defamatory reviews or content
• Engage in any unfair practice within the meaning of the Consumer Protection (Fair Trading) Act 2003
• Impersonate any person, business, or entity
• Use automated tools, bots, or scrapers to extract data from the site without our prior written consent
• Attempt to gain unauthorised access to any part of the platform or its underlying infrastructure, in breach of the Computer Misuse Act 1993
• Use the site to send unsolicited commercial electronic messages in breach of the Spam Control Act 2007
• Engage in any activity that disrupts, interferes with, or damages the platform or its users
• Submit content that is offensive, obscene, discriminatory, or in violation of Singapore law
• Use the platform for any commercial purpose without our prior written approval

5. User-Submitted Content

When you submit a review or any other content on market.com.sg, you grant us a non-exclusive, royalty-free, perpetual, worldwide licence to display, reproduce, adapt, and distribute that content on our platform and in connection with promoting our services.

You warrant that any content you submit:

• Is based on your genuine, first-hand experience with the business or service reviewed;
• Is honest, accurate, and not misleading or deceptive;
• Does not constitute an unfair practice under the Consumer Protection (Fair Trading) Act 2003;
• Is free from personal attacks, hate speech, or discriminatory language;
• Does not defame any individual or business under the applicable defamation laws of Singapore; and
• Does not infringe any third-party rights, including copyright, trade mark, or privacy rights.

We reserve the right to remove, edit, or refuse to publish any user-submitted content at our sole discretion, without notice or liability to you.

6. Business Listings

Search results and business information displayed on market.com.sg are sourced from third-party data providers, including Google, and are provided for informational purposes only. We do not independently verify the accuracy, completeness, or currency of any business information, including opening hours, contact details, pricing, ratings, or service descriptions.

market.com.sg is not affiliated with, endorsed by, sponsored by, or responsible for any of the businesses listed in search results. Any dealings you have with a listed business are solely between you and that business.

7. Intellectual Property

All original content on market.com.sg — including the market.com.sg name, logo, website design, layout, and code — is the intellectual property of market.com.sg and is protected under the Copyright Act 2021 and other applicable Singapore intellectual property laws.

You may not reproduce, copy, distribute, modify, or use any of our proprietary content for any commercial or public purpose without our express prior written permission. Nothing in these Terms & Conditions grants you any licence or right to use our intellectual property.

If you believe that any content on our platform infringes your intellectual property rights, please contact us at support@market.com.sg.

8. Third-Party Services

market.com.sg integrates with third-party services including but not limited to Google Analytics, Google Maps and Places, and social sharing platforms (WhatsApp, Telegram, Facebook, X/Twitter). Your use of these services is subject to their respective terms of service and privacy policies, which we encourage you to review. We are not responsible for the content, availability, accuracy, or practices of any third-party service.

Your use of mapping and place data on the Platform is additionally subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy. Where you obtain our apps from the Apple App Store or Google Play, your use of those stores is subject to their own terms.

9. Consumer Protection

Our platform is provided to consumers in or interested in Singapore. Nothing in these Terms & Conditions excludes, restricts, or modifies any right or guarantee that you have under the Consumer Protection (Fair Trading) Act 2003 or any other applicable Singapore consumer protection law that cannot lawfully be excluded, restricted, or modified.

10. Disclaimer of Warranties

Subject to your non-excludable rights under Singapore law, market.com.sg is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no representations or warranties of any kind, express or implied, regarding:

• The availability, continuity, or error-free operation of the platform;
• The accuracy, completeness, or currency of search results or business information;
• The fitness of the platform for any particular purpose; or
• The security of data transmitted through the platform.

11. Limitation of Liability

To the fullest extent permitted by Singapore law (and subject to your non-excludable rights as a consumer), market.com.sg and its owners, operators, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of, or inability to use, the platform;
• Reliance on any information or search results displayed on the platform;
• Any dealings with businesses listed in search results; or
• Any unauthorised access to or alteration of your data.

Where our liability cannot be excluded by law, our total aggregate liability to you for any and all claims arising from your use of the platform shall not exceed SGD $100.

12. Indemnification

You agree to indemnify, defend, and hold harmless market.com.sg and its owners, operators, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the platform in breach of these Terms & Conditions;
• Any content you submit to the platform; or
• Your violation of any applicable Singapore law or the rights of any third party.

13. Privacy

Your use of market.com.sg is also governed by our Privacy Policy, which is incorporated into these Terms & Conditions by reference. We encourage you to review our Privacy Policy to understand how we collect, use, and protect your personal data in accordance with the Personal Data Protection Act 2012 and the guidelines of the Personal Data Protection Commission (PDPC).

14. Modifications to the Platform

We reserve the right to modify, suspend, or discontinue any feature or part of market.com.sg at any time and without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service, except to the extent required by applicable Singapore consumer protection law.

Our search function depends on a third-party data provider and is subject to capacity limits. Search may therefore be unavailable, reduced, rate-limited, or restricted to previously cached results from time to time, including where a daily or monthly allowance has been reached. We do not guarantee that any particular search will return results, or that the Platform will be continuously available. The Platform is provided free of charge on that basis.

15. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes in our practices, applicable law, or the nature of our platform. The updated version will be posted on this page with a revised "Last Updated" date. Your continued use of market.com.sg after the posting of changes constitutes your acceptance of the updated Terms & Conditions. We encourage you to review these terms periodically.

16. Termination

We reserve the right to suspend or terminate your access to the platform at any time, with or without notice, if we reasonably believe you have breached these Terms & Conditions or any applicable law. Termination does not affect any rights or obligations that arose prior to termination.

17. Governing Law and Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Singapore. You agree to submit to the non-exclusive jurisdiction of the courts of Singapore for the resolution of any dispute arising under or in connection with these terms.

We encourage you to contact us in the first instance at support@market.com.sg to attempt to resolve any dispute informally before commencing legal proceedings.

18. Severability

If any provision of these Terms & Conditions is found to be invalid, unlawful, or unenforceable under Singapore law, that provision shall be deemed severed from the remaining terms, which shall continue in full force and effect.

19. Our Mobile Applications

Subject to your compliance with these Terms & Conditions, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the market.com.sg app on a device that you own or control, for your own personal, non-commercial use. We reserve all rights not expressly granted.

You must not, and must not permit any other person to: copy, modify, or create derivative works of the app; reverse engineer, decompile, or disassemble the app, except to the extent that this restriction cannot lawfully be excluded; rent, lease, lend, sell, sublicense, or distribute the app; remove or obscure any proprietary notice; use the app to build a competing product or to extract data at scale; or use the app in any manner prohibited by Section 4.

The apps are provided free of charge. We may issue updates from time to time, and may require you to install an update in order to continue using the app. We may discontinue an app in accordance with Section 14.

You are responsible for your device, for your network connection, and for any charges your carrier imposes. Location and notification features depend on permissions that you control in your device settings, as described in our Privacy Policy.

20. Additional Terms for Apps Obtained from the Apple App Store

This section applies only where you obtain our app from the Apple App Store, and applies in addition to the rest of these Terms & Conditions. In the event of a conflict, this section prevails in respect of that app.

• These Terms & Conditions are concluded between you and market.com.sg only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the app and its content.
• Your licence to use the app is limited to a non-transferable licence to use it on any Apple-branded device that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions.
• Apple has no obligation whatsoever to furnish any maintenance or support services in respect of the app.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our responsibility.
• We, not Apple, are responsible for addressing any claim by you or a third party relating to the app or your possession and use of it, including product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
• We, not Apple, are solely responsible for the investigation, defence, settlement and discharge of any third-party claim that the app, or your possession and use of it, infringes that third party's intellectual property rights.
• You represent and warrant that you are not located in a country that is subject to a United States Government embargo or that has been designated as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of this section. Upon your acceptance of these Terms & Conditions, Apple will have the right (and will be deemed to have accepted the right) to enforce this section against you as a third-party beneficiary.

21. Entire Agreement

These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and market.com.sg with respect to your use of the platform and supersede all prior agreements, representations, and understandings.
